Well, here’s the deal.

The title is not getting transferred to me. It can’t be transferred to me, unless I file for a special lien. And that would drag the process out for months, which helps me not at all.

PM told me that they handle all transfers. I checked with the state, and they have still not filed for one (and they seem unaware that they have fubarred the title anyway).

PM also told me the furnace was working. It’s not. Without that assurance, I sure as hell would not have signed an as-is. The contractor told me that it hasn’t been lit in at least a year. And there are inner parts missing. Like parts that keep the house from filling up with natural gas and carbon monoxide fumes.

TL, DR; Imma gonna go to court. (luckily the amount is under $10K, so I can go to small claims)

The house I bought for my daughter had the furnace installed backwards. Brand new, but it had never worked in that location and turning it on would have caused severe problems.

Well, the trailer once belonged to Mr. K. Mr. K either had the trailer taken away (the park can do that, if there are unpaid bills), or sold it to Ms. H. Ms. H did a whole hell of a lot of crap, and the park filed to take it away from her.

The title is still in Mr. K’s name. When the park sent in the application to transfer title to Ms. H, they neglected to send in the application fees. That application has been sitting in Sacremento waiting for a check for fees since June '14. (and yes, they sent several notices to that effect, which may explain why Ms. H was hell-bent on revenge, as the neighbor tells me).

When the park filed suit for a writ of possession, they neglected to check all the information on it. So legal possession now rests in the hands of a company that doesn’t exist. No, seriously.

They also neglected to file a transfer with the state (although they wouldn’t have been able to anyway). And they forgot to file with the court for a writ of conveyance, which would have given them the right and authority to sell it to someone else (such as moi).

As it stands, the park has no standing with regards to ownership or possession of the trailer.

In order to transfer title, the applicant has to show that it is being transferred from a titleholder to the purchaser. There’s no transfer from Mr. K to Ms. H, to the park, to me. Think of it as a broken chain of evidence - such evidence as exists can not be used as proof.

I’m not complaining about the legal process. The process makes sense to me. What I am pissed off about is that the park made representations to me that are false and fraudulent.

Shouldn’t the title insurance company be covering all this?

Then again, shouldn’t they have caught it before the sale in the first place?

Title on a mobile home is different. There is no title insurance that I am aware of, and the woman who is my contact with the state confirms that.

ETA: Think of it less of a title on a home, and more a title on a vehicle.

Yeah, this bit sounds pretty accurate - I hope your court case goes well. It seems pretty open and shut to me, which probably means it’ll be a nightmare.

Well, the requirement for going to small claims is to send a demand letter first. I am seeing legal aid tomorrow to make sure I have everything, and then I send the letters.

A friend of mine is going to let us stay with him for a while. Most of my stuff has to go into storage for the time being. I am hoping to be out of here by next Monday, regardless of whether they pay me off.

Well, that’s curious. The hose on the detachable shower head started leaking, so I bought a new unit. And all of the sudden, the amount of water that doesn’t go up to the shower head had dropped to a fast trickle. Let’s call it 1% or less of the total water that could go upwards is instead going down into the bathtub spout. I have no idea why it made a difference.

Don’t have to mess with the valve body now. Yay. I’ll move the board later before the drywall goes back up.

Maybe the new one has less back pressure? A slightly larger inside diameter?

In any case, good news is always welcome, no?

Except when something fixes itself there is always the worry that it didn’t actually fix itself but just got worse somewhere you can’t see.

Like when the kitchen sink magically unblocks itself, and then three days later you realise that the greywater drain for the whole street has exploded underneath your garden shed…

I am putting off cleaning ours out for every reason you just listed. and reading that. It’s just moved a few more spots down again. :slight_smile:

They’re ignoring the demand letter that I sent by certified mail. Instead I got a “pay or get out” letter by certified mail today.

And they’re refusing to talk to me on the phone.

I’m heading to small claims in the morning. Yay me.

They sold you something that wasn’t what they said it was, livable. They also didn’t actually own it because they were too stupid to file the proper lien. Now they want more money for it. Real class acts you’re dealing with there.

This sounds awful! And I thought our last landlord was a douche. Well, I still do think she’s a douche, and she’s got Environmental Services looking for her now. So glad to be out of there.

But you have one mighty strong case there for small-claims. Even an East Texas court couldn’t say you’re in the wrong here.

They’re trying to insist that “they’re two separate entities”. They are referring to the purchase and the lease agreement.

Those are not two separate “entities”. They are both agreements with the same entity.

The inspector for the energy savings program came by a few days ago, and was really pissed that the furnace had not gotten replaced. He’s going to his boss about it, and have the contractors come back out.

Yeah, the gas company isn’t going to be replacing the furnace.

Community Action says they have a program that will, but management is refusing to let me have January’s accounting of my utility bill.

That’s right, the bill I am supposed to get on the first of every month, and pay by the 5th, regardless of weekends and holidays. They are refusing to give me that.

Anyone else realize what they just did to themselves?
